Tentative Recommendation on Mechanics Lien Law

Kim Lamberty at CMA, just received an email from the Real Property Law Section of the California State Bar. It references suggested changes to the California Mechanics Lien Law and asks the lawyers to weigh in with their thoughts. If you are affected by Mechanics Lien laws you may also want to express your opinion of how these suggested changes will work (lawyers don't know everything about how laws actually apply in the real world). This is your chance to get involved and make sure the changes being made have a positive affect on your business.

From the email to Kim:

The California Law Revision Commission has issued its Tentative Recommendation on Mechanics Lien Law, for which public comments are sought by September 30, 2006, prior to submission to the Legislature in 2007. The recommendation proposes a complete revision of California mechanics lien law and associated construction remedies.

The 272-page report summarizes existing California law and the proposed revisions generally, followed by proposed code language. Certain items are noted in bold for which the Commission particularly seeks input from practitioners in this area of law. Generally speaking, they would welcome input on missed items, problems with drafting such as conflicting provisions, and input regarding items that may be contrary to real world practice.

To receive timely consideration, formal comments should be received by the California Law Revision Commission by September 30, 2006.
